These terms govern purchases placed through the Curtain Master online store.

In these terms, “Curtain Master”, “we”, “us” and “our” refer to Curtain Master CC.
2. Application of These Terms
2.1 These terms apply to products ordered through www.curtainmaster.co.za.
2.2 By submitting an online order and accepting these terms at checkout, the customer agrees that these terms form part of the transaction.
2.3 Custom-made, personalised, altered or cut-to-size products are also governed by the Curtain Master Custom-Made and In-Store Order Terms.
2.4 If the two documents conflict, the Custom-Made and In-Store Order Terms apply to the custom manufacture, measurements, cancellation and installation aspects of the order.
2.5 Order Documents and Order of Precedence.
2.5.1 Subject to clause 2.4, where there is any inconsistency between these terms and any document relating to a particular order, the following order of precedence will apply:
(a) mandatory applicable law;
(b) any express written variation that specifically refers to the order and is signed or otherwise expressly approved in writing by both Curtain Master and the customer;
(c) the accepted quotation or order confirmation and the approved written specifications; and
(d) these terms.
2.5.2 A quotation, order confirmation or invoice may record a transaction-specific price, payment arrangement or other variation. That variation will take precedence only if it was expressly approved in writing by both Curtain Master and the customer.
2.5.3 An invoice, pro forma invoice, statement, receipt, job card or delivery note does not, by itself, amend the agreement or introduce new terms. It serves as a record of the transaction unless it expressly records a variation approved in accordance with clause 2.5.1(b).
2.6 Nothing in these terms excludes or limits any right or remedy that cannot lawfully be excluded under the Consumer Protection Act, the Electronic Communications and Transactions Act or other applicable law.
3. Products, Images and Colours
3.1 Curtain Master takes reasonable care to describe and display products accurately.
3.2 Product images are illustrative. Colours can appear different because of lighting, photography and screen settings. Customers who require an exact colour match should request or examine a physical sample before ordering where one is available.
3.3 Minor variations in colour, texture, weave, grain, print positioning or dye lot can occur between samples, batches and finished products. A variation will not be treated as a defect where the product still materially corresponds with its description, sample and reasonable quality standards.
3.4 Product dimensions are stated on the relevant product page. The customer must confirm that the selected size and product are suitable before placing the order.
3.5 Curtain Master will not substitute a materially different product without the customer’s written approval.
4. Availability and Order Acceptance
4.1 Products and prices are subject to availability and verification.
4.2 Before submitting an order, the customer will be given an opportunity to review the order, correct mistakes or withdraw from the transaction.
4.3 An automatic order acknowledgement confirms receipt of the order but does not necessarily constitute acceptance.
4.4 A contract is concluded when Curtain Master sends an order-acceptance or dispatch confirmation, unless Curtain Master expressly confirms acceptance earlier.
4.5 If an item is unavailable, incorrectly priced or cannot reasonably be supplied, Curtain Master will inform the customer promptly. The customer may select an agreed alternative or receive a refund of the affected amount.
4.6 Curtain Master will not charge a customer for a substitute product without the customer’s approval.
5. Prices and Payment
5.1 All prices are displayed in South African rand and include VAT.
5.2 Any applicable delivery charges and other compulsory fees will be disclosed before the customer submits the order.
5.3 Online orders must be paid in full before dispatch or collection.
5.4 Payment must reflect and clear in Curtain Master’s account before any goods may leave the premises.
5.5 Payments are processed through the payment methods displayed at checkout. The customer must ensure that all payment and billing information is correct and that the customer is authorised to use the selected payment method.
5.6 An order will not be dispatched merely on the basis of a proof of payment where the funds have not yet cleared, unless Curtain Master expressly agrees otherwise in writing.
6. Delivery and Collection
6.1 Available delivery areas, methods, charges and estimated delivery periods will be displayed at checkout or communicated before the order is accepted.
6.2 Orders will be delivered to the address supplied by the customer. The customer is responsible for checking that this information is correct.
6.3 Unless another period has been agreed, Curtain Master will execute an online order within 30 days as required by applicable law.
6.4 Delivery dates are estimates unless expressly confirmed as fixed. If a delay occurs, Curtain Master will notify the customer as soon as reasonably possible.
6.5 If Curtain Master cannot execute the order within the agreed or legally applicable period, the customer may exercise any cancellation and refund rights available under applicable law.
6.6 Risk remains with Curtain Master until the goods have been delivered to and accepted by the customer or the customer’s authorised recipient.
6.7 Additional delivery costs caused by an incorrect address, unavailable recipient or unreasonable refusal of a valid delivery may be charged to the customer, provided the cost is disclosed and reasonable.
6.8 The customer should inspect the parcel promptly and report visible courier damage, missing items or incorrect goods as soon as reasonably possible. Delayed reporting does not remove any statutory rights.
7. Online Cooling-Off and Change-of-Mind Returns
7.1 Where the statutory online cooling-off right applies, a customer may cancel an order for standard, non-customised goods without giving a reason and without penalty within seven days after receiving the goods.
7.2 To exercise this right, the customer must notify Curtain Master at admin@curtainmaster.co.za within the seven-day period.
7.3 The customer is responsible only for the direct cost of returning goods cancelled under the online cooling-off right.
7.4 Curtain Master will refund the payment within the legally required period, being no later than 30 days after cancellation where section 44 of the Electronic Communications and Transactions Act applies.
7.5 The customer must take reasonable care of the goods and, where reasonably possible, return them with their original packaging, accessories and documentation. The customer should not use the goods beyond what is reasonably necessary to inspect them.
7.6 Outside a statutory return right, a change-of-mind return may be accepted at Curtain Master’s discretion and subject to agreed conditions.
8. Products Excluded From Change-of-Mind Cooling-Off
8.1 The online cooling-off right does not apply where the law excludes it, including goods which:
- were made or altered to the customer’s measurements or specifications;
- were clearly personalised;
- were cut from a roll or cut to a selected length;
- cannot reasonably be returned because of their nature; or
- fall within another lawful statutory exception.
8.2 Examples may include custom-made curtains, blinds, headboards, furniture or upholstery; cut fabric; cut tracks, rods, flooring or cladding; altered ready-made curtains; and specially ordered personalised products.
8.3 This exclusion applies only to cancellation because the customer changed their mind. It does not remove the customer’s rights if the product is defective, unsafe, incorrectly supplied or does not materially conform to the agreed specifications.
9. Incorrect, Damaged or Defective Goods
9.1 If goods are delivered incorrectly, damaged, incomplete or materially different from their description, the customer must notify Curtain Master as soon as reasonably possible and provide the order number, photographs and relevant details where available.
9.2 Curtain Master may reasonably inspect the goods before determining the appropriate remedy.
9.3 Where goods fail to satisfy the standards required by the Consumer Protection Act within six months after delivery, the customer has the remedies provided by that Act, which may include repair, replacement or refund at the customer’s direction.
9.4 Where Curtain Master is legally responsible for the return, the return will be at Curtain Master’s risk and expense.
9.5 Manufacturer or supplier warranties may continue beyond six months. The applicable warranty period and procedure will be communicated where relevant.
10. Installation, Use and Product Care
10.1 Products must be measured, installed, operated, cleaned and maintained in accordance with their instructions.
10.2 Damage caused by incorrect customer measurements, misuse, abuse, accidents, unauthorised alterations or defective third-party installation is not a product defect to the extent that the relevant damage was caused by that act.
10.3 If Curtain Master did not perform the installation, the customer must give Curtain Master a reasonable opportunity to inspect the product before arranging third-party repairs or alterations, except where urgent action is reasonably necessary.
11. Privacy
11.1 Personal information will be processed for order administration, payment, delivery, customer service, legal compliance and other legitimate business purposes in accordance with applicable data-protection law.
11.2 Marketing communications will only be sent in accordance with applicable law, and customers may opt out using the method provided.
11.3 Any separate Curtain Master Privacy Policy published on the website must be read together with this clause.
12. Limitation of Responsibility
IMPORTANT NOTICE: Nothing in these terms excludes liability for gross negligence or any other liability or consumer right which cannot lawfully be excluded.
12.1 Subject to the important notice above, Curtain Master is not responsible for loss or damage caused by:
- incorrect information or measurements supplied by the customer;
- misuse, abuse or failure to follow product instructions;
- third-party installation, repair or alteration;
- undisclosed dampness, structural defects or unsuitable surfaces;
- ordinary wear and tear; or
- events outside Curtain Master’s reasonable control.
12.2 Any limitation applies only to the extent that the relevant event caused or contributed to the loss.
13. Events Beyond Our Reasonable Control
13.1 Delivery or performance may be delayed by events outside Curtain Master’s reasonable control, including severe weather, fire, flooding, strikes, major transport interruptions, extended electricity failures or unexpected supplier shortages despite reasonable procurement efforts.
13.2 Curtain Master will notify the customer and take reasonable steps to reduce the delay.
13.3 This clause does not remove any statutory right to cancel or obtain a refund where Curtain Master does not perform within the agreed or legally applicable period.
14. Complaints and Disputes
14.1 Complaints must first be submitted to Curtain Master using the details below.

14.2 The customer should include the order number, a description of the issue, supporting photographs where relevant and the requested resolution.
14.3 Curtain Master will investigate and respond within a reasonable period.
14.4 If a consumer complaint remains unresolved, the customer may approach the Consumer Goods and Services Ombud, the National Consumer Commission or another body with lawful jurisdiction.
15. General
15.1 South African law governs these terms.
15.2 If any provision is invalid or unenforceable, it will be limited or severed to the minimum extent necessary, without invalidating the remaining provisions.
15.3 The version accepted when the customer placed the order governs that transaction. Later amendments will not retrospectively alter an existing order.
15.4 Any change to an accepted order must be agreed in writing.
